1. Who we are

PropColony is an online platform connecting verified real estate agencies with certified independent associates who refer qualified property buyers.

2. Accounts

  • You must be 18 or older and provide accurate information.
  • Associates must complete identity verification and certification before earning commission.
  • Agencies must be legally registered and verified.
  • You are responsible for keeping your login details secure.

3. Leads and attribution

Lead ownership is recorded when a lead is submitted. The first valid lead for a buyer wins attribution within the applicable attribution window. Agencies must report every sale involving a PropColony lead.

4. Fees

  • Agency platform fee: 2% of the associate commission, payable by the agency.
  • Associate service fee: 5% of the associate commission, deducted from the associate payout.
  • Associate commission is set per property between 6% and 10% of the agency commission.
  • All amounts are shown in South African Rand (ZAR) unless otherwise stated.

5. Settlements and payments

Settlements are generated once a sale is verified. Agencies may review settlement details during the confirmation window; once confirmed, settlement amounts are locked. Payments are processed securely by Paystack. PropColony does not store card details.

Where an associate's payout account is linked, the associate's net commission is split to them automatically at checkout. Otherwise PropColony receives the funds and pays the associate by bank transfer.

6. Disputes

Disputes about attribution or settlement must be raised through the platform or by email within 14 days. PropColony will mediate using platform records, and its decision on attribution is final save where law provides otherwise.

7. Prohibited conduct

  • Submitting false leads or buyer information.
  • Circumventing the platform to avoid fees on PropColony-introduced buyers.
  • Misusing other users' personal information.

8. Suspension

We may suspend or close accounts that breach these terms, while honouring settlements already owed for verified sales.

9. Liability

PropColony is an introduction and settlement platform and is not a party to property sale agreements. To the extent permitted by law, our liability is limited to the fees we earned on the transaction concerned.

10. Governing law

These terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act and the Electronic Communications and Transactions Act.
